Long-Term Care and Medicaid Planning

Institutionalized long-term care for seniors such as is provided by Assisted Living Facilities and Skilled Nursing Facilities (often called nursing homes) can be prohibitively expensive, costing $10,000-$12,000 and more per month. Most seniors and their families cannot afford this.

Medicaid may pay for all or some of these expenses - if one can qualify for Medicaid. Generally, one must establish a need for a certain level of care. Furthermore, Medicaid places a limit on assets and monthly income an applicant can have and still qualify.

A simple property transfer out of the Medicaid applicant's name will not be sufficient and will often lead to more complications and even penalties if done within 5 years of filing an application. Careful planning, using such tools as a Qualified Income Trust, will allow the applicant to qualify for Medicaid, while also preserving assets. Such planning tools can be complicated and Medicaid applicants should consult an experienced elder law attorney.
